1. Who we are

This website is operated by Delvo Digital, a sole proprietorship owned by Dominic Diaz, based in Northern California. We design and build websites, automated phone lines, campaigns and custom software for local businesses. Contact: dominic@delvodigital.com.

2. What this page covers

These terms cover your use of delvodigital.com. They do not cover the services we provide to clients. Those are governed by a written agreement signed by both parties: a master services agreement, an order form and the service schedules that go with it. Nothing on this website is a contract or an offer to contract, and nothing here changes a signed agreement.

3. Information on this site

We work to keep this site accurate and current, but we make no warranty that everything on it is complete or error-free. We quote every build in writing before any work starts. Final pricing depends on scope and is confirmed in a written order form. We don’t publish prices; every price is in a written order form.

4. Sample businesses and concept builds

The businesses shown in our work and in our concept builds are made up. Marrowstone Landscape Co., Hushwater Mobile Detail and the others are not real companies, the people in their examples are not real people, and every number, address, name and message in them is sample data. Each of those pages says so on its face. Any resemblance to a real business or person is coincidence. They show how our software works; they are not claims about results.

5. How we work with clients, in brief

This is a plain-English summary of how we work with paying clients. It is here so you know what to expect before a call. It does not replace the written agreement, and where the two differ, the agreement is what counts.

  • A written agreement first. Every engagement starts with a signed master services agreement and an order form that lists the services, the fees, the dates and the payment terms. Nothing starts before it is signed. Prices are never on this site; they are on your order form.
  • Two ways to work with us. Most clients choose build and plan: you pay a build fee, then one monthly maintenance plan written for your business that lists exactly what it covers (hosting, updates, running the phone line, a small-change allowance). Build and hand-off: you pay one build fee and we hand everything over; every account is in your name and the code is in your own account.
  • No long-term contracts. The maintenance plan is month to month. You can cancel at any time, and the cancellation takes effect at the end of the period you have already paid for. There is no minimum term and no cancellation fee.
  • Ownership. Your content, your data, your domain and the accounts in your name are always yours. On a plan, the software we build is licensed to you, and you can buy it outright at any time for the price on your order form, less the build fees you have already paid. On a hand-off, the software is yours once the build fee is paid in full.
  • Fixes. While you’re on a plan, if something we built stops doing what the order form says, we fix it at no charge. After a hand-off, we fix it at no charge for 30 days after go-live, and after that our time is hourly. New features and changes are quoted separately.
  • When a plan ends. You get a complete export of your data and content at no charge, and your domain stays yours. The software keeps running for 30 days after your last paid period, so you have time to buy it out or move; after that, software that has not been bought out goes offline.

6. Our content

The design, text, code and images on this site belong to Delvo Digital unless credited otherwise. You may not copy or reuse them commercially without our written permission.

7. Contacting us and booking a call

The contact page lets you pick an open weekday time and composes an email in your own mail app; sending it is up to you. The time you pick is a request for a call with Dominic. We confirm it by email or by calling you back, and the call is confirmed only when we have. By writing to us you agree to give accurate information and not to use the page for spam or anything unlawful. We do not guarantee a response, and writing to us does not by itself create a business relationship.

We sometimes link to other websites. We do not control them and are not responsible for their content or practices.

9. Limits on our liability

This website is provided “as is.” To the fullest extent permitted by law, Delvo Digital is not liable for any damages arising from your use of it, including indirect or consequential damages. Nothing here limits liability that cannot be limited under California law. Our responsibilities to clients are set out in the signed agreement, not on this page.

10. Changes

We may update these terms. The date above tells you when we last did. Continuing to use the site means you accept the current version.

11. Governing law

These terms are governed by the laws of the State of California. Disputes about this website will be handled in Solano County, California.
